Prescribed Forms
 
All licensed developers are required to use the prescribed Option to Purchase and Sale & Purchase Agreement (landed properties / strata titled properties) in the sale of housing units.
 
Developers who are selling commercial properties in a building containing more than 4 separate units before the issue of the certificate of statutory completion and subsidiary strata certificate of title are also required to use the prescribed Option to Purchase and Sale and Purchase Agreement.
 
Any variations to the standard terms and conditions in the prescribed forms have to be approved by the Controller.
 
Pre-approved Amendments
 
To facilitate developers’ request for amendments to the prescribed forms, the Controller has pre-approved a list of amendments which are frequently requested for and approved. A developer may adopt any of the pre-approved amendments without seeking further approval from the Controller.

Change Of Name In Option
 
An Option to Purchase granted by a developer is not assignable or transferable. The Controller's approval has to be obtained for any change of name in the Option and he will consider applications for a change of name in an Option under the following circumstances -
 
a
deletion of names as long as one of the joint option holders remains as the option holder; or
b
addition of the names of immediate family members (ie. spouse, parents, children or siblings); or
c
substitution of a name with that of an immediate family member (ie. spouse, parents, children or siblings) as long as one of the joint option holders remains as the option holder.
 
Only one change is however allowed for an Option. If an application is approved, the developer has to issue a fresh Option to Purchase.
 
In an application for a change of name in an Option, the developer / purchaser or their solicitors should furnish the following to the Controller -
 
a
copy of the Option to Purchase;
b
letter by the solicitors for the developer/ purchaser, verifying the following -
  i        Option has not been exercised;
  ii       date of expiry of Option; and
c
documentary evidence of immediate familial relationship, if applicable.
 
Booking Registers
 
Developers are required to maintain a register in the prescribed format showing the particulars of those persons who have obtained Options for the purchase of their residential/ commercial properties.
